Terms of Service
These Terms of Service govern access to and use of the Kola VPN service. By creating an account or using the service, you accept them in full.
1. Purpose
These terms govern the relationship between LTC GROUP SARL, publisher of the Kola VPN service ("we"), and any person who creates an account or uses the service ("you"). They set out each party's rights and obligations. The processing of your personal data is described in our Privacy Policy, which forms an integral part of these terms.
2. Definitions
"Service" means the Kola VPN application and the infrastructure used to establish a virtual private network connection. "Account" means the personal space created at registration. "Plan" means a paid subscription package. "Device" means a terminal (Android, iOS, macOS or Windows) linked to your account. "Free trial" means the limited evaluation period offered to new accounts.
3. Registration and account
Registration requires a valid phone number or email address and a password. You are responsible for the accuracy of the information provided, the confidentiality of your credentials, and any activity carried out from your account. An account is strictly personal: sharing credentials with third parties is prohibited. You must have the legal capacity to enter into a contract.
4. Plans, prices and payment
The service is offered via a free trial, then paid plans denominated in CFA francs (XAF): monthly 5,000, quarterly 10,000, half-yearly 18,000 and annual 30,000. Each plan allows a number of simultaneous devices: 2 for monthly, 3 for quarterly, 5 for half-yearly and annual. Payments are processed by our providers (Mobile Money and card via Stripe). Subscriptions are taken out for the chosen term; unless stated otherwise at purchase, they do not renew automatically. Prices may change, with no effect on an already-paid subscription.
5. Use of the service
The service is licensed to you for personal and lawful use. It does not guarantee absolute anonymity or access to any specific content. You are solely responsible for the compliance of your use with the laws applicable to you. The service applies a fair-use policy: consumption is measured but paid plans are not volume-capped; the free trial is limited to 3 days or 20 GB, whichever comes first.
6. Acceptable use policy
You must not use the service to: commit an offence or infringe the rights of others; distribute malware or spam, or carry out network attacks; attempt to circumvent technical limits, resell or share access; or engage in any activity likely to degrade the service for other users. Breaching these rules may lead to suspension or termination of the account, without refund.
7. Term and termination
The contract takes effect when the account is created and continues while a plan is active. You may stop using the service and request deletion of your account at any time. We may suspend or terminate access in the event of a breach of these terms, in particular the acceptable use policy. Termination does not give rise to a refund of the current period, except where mandatory law provides otherwise.
8. Availability and liability
We strive to ensure continuity of the service but do not guarantee uninterrupted availability: interruptions may occur for maintenance, updates or causes beyond our control. To the extent permitted by law, our liability is limited to the amount paid for the subscription concerned and does not cover indirect damages.
9. Intellectual property
The application, the "Kola VPN" trademark, the logos and all elements of the service are protected and remain our property or that of our licensors. Integrated third-party and open-source components remain subject to their respective licences. Nothing in these terms transfers to you any intellectual property right beyond the right to use the service.
10. Governing law and disputes
These terms are governed by the laws of Cameroon. In the event of a dispute, the parties will seek an amicable solution before any action; failing that, jurisdiction is granted to the courts of the registered seat of LTC GROUP SARL, subject to mandatory consumer-protection rules.
